The European Court of Justice criticizes Spain on gambling winnings taxationOctober 8, 2009, 10:57 am (2 years ago)The European Court of Justice has found that a Spanish government tax regulation on gambling winnings, to which the European Commission had claimed, is faulty and prejudiced.
In a conclusion issued on October 6 in Case number C153/08, the ECJ 1st chamber ruled in opposition to Spain concerning its tax exemption regarding to winnings. The case was brought up to the ECJ by the European Commission and focused on legislation taxing winnings from variety of lotteries, games and betting established externally from the Kingdom of Spain. However, winnings from lotteries, games and betting organized within Spain by some not-for-profit or social welfare bodies were excused from the tax. The Advocate-general’s decisions on this matter were that the action should be partly allowed. By keeping in force tax legislation that doesn’t apply to public bodies and entities that conduct activities of a social or non-profit character built in a different member state and following the same aims as the Spanish entities concerned, Spain had not succeed to recognize the freedom to offer services and breached the standard of non-unfairness on basis of nationality.
