By mutual agreement of all parties involved, a case involving the Interactive Media Entertaining & Gaming Association against the United States Attorney General, along with the Federal Trade Commission and the Federal Reserve Board of Governors, has recently been rescheduled for September 26th. The case is set to be heard by Honorable Judge Mary L. Cooper in New Jersey’s US District Court.
The Plaintiff in the case, IMEGA, had recently placed a temporary restraining order against the US Government through the Unlawful Internet Gambling Enforcement Act, an Act that prohibits financial transactions with Internet Gambling companies.
The reason cited for the action by IMEGA is that the company claims that the defending organizations have impacted present and future Constitutional freedoms, not specific online gambling issues. IMEGA has stated that the law in question creates bad precedent and is likely to affect the innovation and growth of US e-commerce in a negative way.
Judge Cooper is set to hear oral arguments, both on IMEGA's petition, as well as the response by the defending government agencies requesting that the motion by IMEGA ultimately be dismissed. IMEGA will also be permitted to give their argument as to why their proposal should not be dismissed.
If IMEGA is successful in winning the courts favor, the regulations and restrictions placed by the UIGEA could be seriously affected.
